In deciding cases, judges carefully consider the testimony of witnesses and the submissions of the parties, take time to reflect on the issues, and then write judgments explaining their reasoning and supporting their conclusions. The way courts function seems a strong model for sound decision-making.
However, recent scholarly writing in psychology and behavioural economics casts doubt on the reliability of human decision-making generally, including decision-making by judges. It seems we are all susceptible to unconscious biases and cognitive illusions. What are the implications for the judiciary? Can judges make better decisions?
This talk by The Honourable James O’Reilly (Federal Court of Canada) will run from 6-7pm (including Q&A session) followed by drinks for those attending in person. The talk will also be streamed online.
