‘The Reasonable Person’
Speaker: Dr Valentin Jeutner
Drawing on his recently published book, Dr Jeutner explores the fascinating history of the common law’s 'reasonable person'. Tracing its development across centuries, legal systems, and jurisdictions, the lecture begins with its roots in ancient Egypt, Greece, and Rome, before examining its emergence during British industrialisation under the influence of Scottish Enlightenment thought.
Following this legal figure through colonial courts, battlefields, and even contemporary debates on self-driving cars, Dr Jeutner argues that the 'reasonable person' encourages judges and jurors to assess conduct by adopting another person’s perspective through empathy.
The talk will also highlight the role of Sir Edward Hall Alderson, who introduced the standard in Blyth v Birmingham Waterworks.
