Since the Human Rights Act 1998, Article 8 ECHR has become a central organising framework in UK law. It sits at the heart of disputes involving data privacy and mass surveillance, extradition, child protection, immigration, and many other areas, requiring public authorities to justify interferences with private and family life through structured proportionality analysis.

Against the backdrop of recurring proposals to repeal the Human Rights Act and replace it with a new domestic rights instrument, this webinar asks: what would life look like without it? Would the common law and Parliament fill the space, or would its absence mark a decisive shift in the balance between individual rights and executive power?

Speakers include Sonalia Naik KC (Garden Court Chambers) and Prof Ian Walden (Queen Mary, University of London). Chaired by Micheál Ó Floinn (University of Glasgow)
