Applicant Privacy Notice

The Honourable Society of The Inner Temple takes your privacy seriously. We'll always keep your personal information safe and secure and will never sell your details.

This privacy notice tells you how we collect and use your personal data, related to our recruitment processes.

Principles

In collecting and processing your personal data, we will comply with the data protection laws which are currently in place. This requires that the personal information we hold about you must be:

  • Used lawfully, fairly and in a transparent way.
  • Collected only for valid purposes that we have clearly explained to you and not used in any way that is incompatible with those purposes.
  • Relevant to the purposes we have told you about and limited only to those purposes.
  • Accurate and kept up to date.
  • Kept only if necessary, for the purposes we have told you about.
  • Kept securely.

The Kind of Information We Hold

The Inner Temple collects and processes personal data, or personal information, relating to applicants for employment at the Inn. Personal data, or personal information, means data about an individual from which that person can be identified. It does not include anonymous data, i.e. data from which the identity has been removed.

The organisation collects and processes a range of information about you. This includes:

  • Identification - your name, nationality, national insurance number, bank details
  • Contact details
  • Education and work experience
  • Organisational data
  • Information collected as part of your interview process
  • Background check information
  • Other application data (e.g., information contained in your CV and obtained from recruiters
  • CCTV images
  • You may be asked for a criminal records declaration to declare any unspent convictions.
  • If the role you are applying for has been assessed as requiring a criminal records check, we will share your name, email address, and details of the role with our third-party supplier, to facilitate a check being conducted with Disclosure and Barring Service.

How Is the Information Collected?

Your information may be collected using a variety of methods. Most will be taken from the details given by you when you apply for employment at the Inn. 

It is possible that information will be sought from third parties where appropriate and reasonable to do so. For example: professional references supplied by former employers.

How Long Do We Keep It and Who Has Access to It?

We have put in place appropriate security measures to prevent your personal information from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed. In addition, we limit access to your personal information to those employees and third parties who have a business need to know. They will only process your personal information on our instructions. It is our policy not to keep personal information for longer than is necessary. 

Your Duty to Inform Us of Changes

The data the Inn holds on you should be accurate and current. Please keep us informed of any changes which may occur during the application process.

What Do We Need to Process Your Information For?

The Inn will need to process your data to comply with its legal obligations:

  • to run a successful, fair and transparent recruitment process,
  • Decide to whom we should offer a job to,
  • to check your entitlement to work in the UK,
  • to check that the information you supply with regards to work history and qualifications is correct,
  • to fulfil any statutory or regulatory requirements.

In these cases, the Inn will rely on Article 6 (1) (c) of the GDPR – legal obligation as the basis for processing.

For the below processing activities, the Inn will rely upon the basis in Article 6 (1) (f) of the GDPR – legitimate interest:

  • run recruitment processes.
  • ensure effective general HR and business administration.
  • respond to and defend against legal claims; and
  • maintain and promote equality in the workplace.

In some cases, it may be necessary to process your data to protect your interests (or the interests of another individual), for official purposes or to protect the public interest.

Your Rights to the Data We Hold on You

The law grants you specific rights to your data under certain circumstances:

  • Right to request access: you may make a ‘Subject Access Request’ to receive a copy of the personal data the Inn holds on you and to check that it is being lawfully processed. You do not have to pay a fee to access your data. The Inn may refuse your request if it is considered unfounded or excessive.
  • The right to data correction: the data we hold on you should be accurate and complete. You have the right to request that any data be corrected or completed.
  • Request erasure: you may ask us to delete personal data where we do not have reason to continue to hold it or are doing so in breach of the data protection principles. Or where we are holding data which you have objected to our processing.
  • Object to processing: Where the Inn is relying on legitimate interest to process the data, you may object to your information being processed if you believe your personal circumstances warrant an objection to processing on the specified grounds. You also have the right to object if your data is used for direct marketing without specific consent.
  • Restriction of processing: You may ask the Inn to suspend the processing of your data, for example, if you wish to ascertain the accuracy of the data or the basis for the processing before any processing takes place.
  • Data Portability: You have the right to request that the Inner Temple provide your data in a commonly used, easily readable format for transfer to another data provider, or for the Inn to transfer that data in the required format for you.

Complaints to the ICO

The United Kingdom’s supervisory body for Data Protection Issues is the Information Commissioner's Office (ICO). You have the right to complain to the ICO at any time.
