Title: Environmental Law: Regulation and the Right to Protest Speakers: Stephen Simblet KC (Garden Court Chambers and Inner Temple Bencher) Sudhanshu Swaroop KC (Twenty Essex) Moderator: Saira Kabir Sheikh KC (FTB and Inner Temple Bencher) The speakers will discuss recent decisions in the civil and criminal courts of England and Wales in relation to protests concerning the environment or climate change. Climate change and environmental catastrophe are real and pressing issues. At the same time there is a view that protests need to be within the bounds prescribed by the law and the rights of others as formulated in a democratic society. The question is whether and to what extent the law corresponds to what is just. In this context, the speakers will also consider changes in the primary legislation impacting the right to protest (concerning inter alia the right to freedom of assembly and freedom of expression) and use of criminal law to proscribe peaceful protest (however construed). Has the use of civil injunctions expanded: and is that remedy operating fairly? And, finally, they will ask whether the right balance is being struck between the rights of protestors and the interference of those rights as a matter of public policy. To what extent is the lack of effective regulation of public and private bodies which are damaging the environment, relevant to the breadth of lawful protest? Is there a balance that can be struck? This event aims to bridge the gap between academic research and real-world experiences and offer an understanding of the current landscape. Speakers: Craig Hassall KC, Park Square Barristers and President of the Inner Temple LGBTQ+ Society (moderator) Brie Stevens-Hoare KC, Gatehouse Chambers Oscar Davies, Garden Court Chambers Reagan Persaud, Spire Barristers Marc Mason, University of Westminster Our speakers will share personal stories and explore what progress is being made towards better inclusivity and equality at the Bar. We will also welcome academic Marc Mason, co-author of the 2017 study on 'Sexuality at the Bar: An Empirical Exploration into the Experiences of LGBT+ Barristers in England & Wales', to speak about the key findings from the research and give an extemporary judgement on progress made since the study took place. Computer-generated evidence is playing an increasing role in legal disputes. This talk discusses the potential impact of computer bugs on the reliability of electronic evidence, including the Post Office Horizon Scandal, and what documentation may be available to assess to what extent it is appropriate to depend on such evidence. A scientific presentation will be given by Steven Murdoch, Professor of Security Engineering, a Royal Society University Research Fellow and head of the Information Security Research Group of the Department of Computer Science at University College London. The legal perspective will be given by The Rt Hon Lord Justice Peter Fraser, appointed in December 2023 as both Chair of the Law Commission of England and Wales and a Lord Justice of Appeal. Call 1978; Silk 1997; Inner Temple Bencher 2003. A founder member of Matrix Chambers, he was appointed a Recorder of the Crown Court in 2001 and elected Chairman of the Criminal Bar Association in 2003. Later that year he became Director of Public Prosecutions (DPP), the first prominent defence lawyer to have been appointed to that post. Completing his term as DPP in 2008, he became a trustee of Index on Censorship, the leading free expression advocacy group, and was appointed Chair of Reprieve, the anti-death penalty organisation, in succession to Lord Bingham of Cornhill. He was appointed a Deputy High Court Judge in 2010, and became a member of the House of Lords in the same year. Open to: Members of the Inns. LGBTQ+ people have existed since as far back as we can chronicle. Sadly, equal measures and steps towards equality have been relatively recent for LGBTQ+ people. In addition, LGBTQ+ rights continue, to a large degree, to be part of western culture rather than worldwide; acceptance being limited on an international scale. This seminar will provide an overview of the history of LGBTQ+ rights, looking at legal and systemic prejudices which have held the queer community back and continue to do so today. The seminar will explore the dangers to the queer community and why certain measures are now considered pivotal to ensuring that LGBTQ+ people are respected and protected in our work as lawyers, judges and academics. The talk will be given by Reagan Persaud, a family law barrister and a member of the LGBTQ+ community. Reagan is also a Deputy District Judge and is now the only trans Judge in England and Wales. Much of Reagan’s professional work and personal interests lie in promoting equality and diversity measures for under-represented groups. Reagan carries out extensive work towards improving the legal system and the way justice is administered for marginalised communities by focusing on systemic injustices and measures that can be taken to improve the way people are treated. Followed by a question and answer session, and then the opportunity for informal discussion at a reception afterwards. A training day for established barristers focusing on the advocacy skills required for appeals cases. The morning will consist of a series of talks on appellate advocacy, including an introduction from the Lady Chief Justice, a perspective from the Supreme Court, and then separate sessions for civil and criminal practitioners, covering oral and written advocacy in the Court of Appeal, as well as tips from experienced practitioners. In the afternoon, delegates will take part in either civil or criminal advocacy sessions, being given feedback on their performances by the Inn’s advocacy trainers, alongside Lord and Lady Justices and High Court Judges. The day will conclude with a plenary and then a drinks reception. Members can choose to attend either the morning only, or the morning and afternoon sessions together, but please note that numbers are strictly limited for the afternoon session, and advance preparation work will be required for this.
